About The Visa:
You may be eligible for a partner visa if you are in a relationship with an Australian citizen, Permanent Resident, or eligible New Zealand citizen.
You must either be married or in have lived together in a de-facto relationship.
Features Of The Visas:
This visa allows the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen to travel to and live in Australia.
To apply for SC 309-100 You must be outside Australia & to apply for SC 801-820 you must be in Australia and married or in a de facto relationship with:
- an Australian citizen
- an Australian permanent resident
- an eligible New Zealand
You must be in a genuine and ongoing relationship. You must live with your partner or, if you do not, any separation must be only temporary.
You can lodge an application for this visa in or outside Australia. If you are in Australia, you can apply only if your temporary visa allows you to apply for another visa while you are in Australia.
Both parties must freely consent to the relationship.
You can apply if you intend to marry your partner before a decision on your visa is made.
In most cases, permanent residence cannot be granted less than two years from when you lodge your application.
You could be granted a permanent visa without having to fulfil the usual two-year waiting period if certain conditions are fulfilled.
